General Terms and Conditions

Scope of Application
All business relations between the German Winegrowers’ Association – Congress and the purchaser are exclusively subject to the following General Terms and Conditions as valid at the time of purchasing.
They apply to all contracts, deliveries or other services made on behalf of the German Winegrowers’ Association e. V. (named here after as DWV). The DWV does not recognize any deviating terms on the part of the contracting party. Any additional agreements are subject to an agreement in writing by the DWV.

Offer
Our offers are provisional. Except in case of a withdrawal (paragraph 7) you are bound to the offer for the duration of four calendar days. The acceptance of the order is under the discretion of the DWV. Particularly with regard to the request for tickets for congress events organized by the DWV, we reserve the right to decline the offer if the event is already sold out.

Prices/ Delivery Charges
All our prices include the legal value added tax, presently at 19% or 7% respectively (for book series), but do not include delivery charges and, if applicable, C.O.D. charges, whereby the delivery of congress tickets remains free of shipping costs.
The total price of the order is payable as soon as the order is placed, either by stating credit card data or by bank transmission (payment in advance).

Terms of Payment
Generally, goods are delivered after receipt of bank transfer or credit card payment.

Delivery
Your order will be processed as soon as possible, by the latest on the working day following receipt of your order. As a rule, delivery is provided within a maximum of 7 working days (Monday – Friday) inside Germany, whereby we are not liable for transportation problems.
In the case of a non-compliance of the delivery or service date due to force majeure, strike, unforeseen obstacles or other circumstances beyond our control, the period of delivery shall be postponed. The DWV will immediately inform the contracting party about the occurrence of said circumstances. These circumstances entitle the DWV to withdraw from the contract.
The commodities are delivered at consumer’s risk. The risk is passed on to the consumer as soon as the commodity is handed over to the mailing firm.

Right of revocation

Instruction on the right of revocation

Natural entities who place an order on shop.dwv.online.de, www.dwv-online.de, www.dwv-online.de/innopreis as well as on www.dwv-online.de/kongress, which cannot be ascribed to their commercial or independent activity (consumer), have a statutory right of revocation § 312 d BGB (i.e. German Civil Code) under the following provisions:

You can revoke the contract within 14 days of receipt without stating reasons in writing (e.g. letter, fax, email) or by returning the commodities. The period shall commence no earlier than receipt of the commodities and these instructions. Punctual dispatching of the commodities or revocation shall be sufficient in order to revoke the contract.

Consequences of Revocation:
In the event of an effective revocation, the consideration received by both parties shall be restituted and any benefits received shall be returned. If you cannot restitute the performance received, either totally or partly or only in a deteriorated condition, you shall, if applicable, be obliged to compensate the DWV. Objects capable of dispatch by parcel shall be returned at our expense.
You shall bear the costs of the return if the commodities supplied correspond to what has been ordered and the price of the commodities to be returned does not exceed an amount of 40.00 Euro or if you have not yet paid the consideration at the time of the revocation in the event of a higher price of the commodities. Apart from this, returns shall be free of charge. Obligations to return a payment have to be fulfilled within 30 days. For you, the period starts with the revocation or return of the commodity, for us with the receipt.

Reservation of Title

We reserve the title to the object of purchase until complete payment of the purchase price

Place of fulfilment and place of jurisdiction is Bonn.
The law of the Federal Republic of Germany applies exclusively.
